These conditions are applicable to all rentals concluded with the owners of La Dessalinienne located at 454 chemin du Camaillon, 83 340 Le Thoronet – France, referred to as “the Lessors”. Therefore, the Client, referred to as “the Lessee”. ” acknowledges having read these General Conditions of Sale and undertakes to respect them.

DURATION

1I   All rental is granted and accepted for a period stipulated in the special conditions of the contract. It cannot be extended under any circumstances, except with the prior written agreement of the Lessors. The initial contract or its possible extensions cannot under any circumstances extend the duration of the rental to more than 90 days.

2I   The Lessee declares on his honor that he does not exercise and does not seek to exercise any profession in rental and that the premises which are the subject of the contract are only rented to him as a temporary holiday residence , major conditions without which the rental would not have been granted.

CONFIRMATION OF RESERVATION

1I  All reservations are firm and final from the signing of the contract and payment of a deposit of 30% of the rental amount.

2I  The Lessee undertakes to take possession of the premises on the date of availability fixed in the contract and to pay the balance of the rental maximum 1 month (30 days) before the start of the rental.

3I   In the absence of receipt of the balance of the rental 1 month (30 days) before the start of the planned rental, the Lessors will have the premises available again without having to reimburse the amount of the deposit paid.

4) Payment of deposits, rental balance and security deposit can only be made via bank transfer. Personal checks and credit cards are not accepted.

CANCELLATION AND REFUND

1I    Cancellation of a reservation may result in partial or total loss of payments made, as indicated below. All cancellations must be made in writing.

The following cancellation fees will be applied:

–      Reservations canceled at least 60 days before the start of the stay may be refunded up to 100% of the total cost of the stay (after deduction of fees);

– Reservations canceled at least 30 days before the start of the stay may be refunded up to 50% of the total cost of the stay (after deduction of fees);

– Reservations canceled less than 30 days before the start of the stay will not be refunded and/or due if they have not yet been paid in full.

2I In the event of force majeure preventing adequate use of the property during the reservation period, the reservation may be canceled without any penalty.

3I   Any request to change the reservation dates or the number of people must be made in writing to the Lessors. The Lessors reserve the right to agree to this based on availability and to consider these modifications as a cancellation or a new reservation, in which case the penalties provided for above may be applied.

4I   If, for reasons beyond the control of the Lessors, the Dessalinienne was not available for the rented period, the Lessee would be reimbursed for all of his payments, without being able to claim any other compensation.< /p>

SECURITY DEPOSIT

1I  The security deposit in the amount of €1,000 is due and payable on the same date that the balance is 1 month (30 days) before the date of arrival at the Dessalinienne.

2I   It is paid to respond to damage that could be caused to the rented property and to movable or other objects furnishing the rented premises. An inventory and inventory is carried out upon the Lessee’s arrival. Failing this, the Lessee is deemed to have received the premises in perfect condition and must return them as such, unless proven otherwise.

3I  The security deposit will be refunded within 10 days after the Peneur’s departure, after deduction of the replaced objects, any costs of repair, additional cleaning (cushions, carpets, sofas or other objects requiring repair). professional cleaning, etc.) as well as any other liability. If the security deposit proves insufficient, the Lessee undertakes to complete the amount.

ARRIVAL – CHECK IN / DEPARTURE – CHECK OUT

1I  Arrivals are from 3:00 p.m. until 8:00 p.m. For any arrival after 8:00 p.m., the Lessee will inform the Lessors, at the latest the day before.

2I   The Lessors will provide the Lessee with 1 set of keys to the property, including garage and gate opening devices, if applicable. On the day of departure, all keys and opening devices for garages and gates will be returned immediately. If these are not returned upon departure, an amount of €150 will be charged to the Lessee for each key/opening device for the swimming pool, access doors or gate not returned.

3I   Departures are between 8:00 a.m. and 10:00 a.m.

SERVICES INCLUDED

The rental of the Dessalienne includes the following services:

– quick bicycle repair shop;

– weekly pool maintenance by approved pool specialist;

– garden maintenance;

– Wifi and Television connection;

– suggested hiking or cycling routes*.

*The Owners decline all responsibility in the event of an accident occurring on the proposed routes as well as guaranteeing the accessibility of the proposed roads and trails.       

SERVICES NOT INCLUDED & DISBURSEMENTS

– the Lessors also offer to personalize the arrival and stay with a specific tailor-made supply list from one of the partners: “La Boucherie du Thoronet” or “le Château de la Martinette”. This service will be invoiced at the actual cost of the expenses made on behalf of the Lessee in addition to an amount of €40/hour of service;

– telephone communications outside France (billing based on the Orange statement);

– departure cleaning charged €120;

– rental of bed, bathroom and swimming pool linen charged at €10/person/week;

– change of room linen carried out during the stay;

– change of bathroom linen and pool towels during your stay;

– house maintenance during your stay.

POOL SAFETY

The swimming pool has a security system that complies with current standards with a motorized cover. The Lessee undertakes to validate the liability waiver given upon arrival.

ANIMALS

Our pets are not allowed.

INTERNET – WIFI

La Dessalinienne offers free WiFi internet access. The User undertakes to ensure that the computer resources made available to it are not used in any way for the purposes of reproduction, representation, provision or communication to the public of works or objects protected by a copyright, by a neighboring right such as texts, images, photographs, musical, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the intellectual property code when this authorization is required.

OBLIGATIONS AND RESPONSIBILITIES OF THE LESSEE

1I   The Lessee undertakes to take the rented premises in the state in which they will be found upon entry into use as described in the descriptive statement of the contract, as a holiday residence.

2I   The Lessee will use the property with dignity and discretion, respecting the neighbors and the neighborhood, as well as the applicable regulations relating in particular to neighborhood disturbances, parking of vehicles on the public road or neighboring private roads, disturbances to the public order, etc…The Lessee releases the Lessors from all liability and irrevocably undertakes to fully compensate the Lessors if they were to be prosecuted and/or be subject to any fines, penalties, convictions or any consequences damaging following the faulty behavior of the Lessee or the occupants under his responsibility. It is specified that noise pollution must cease by 10:00 p.m. at the latest.

3I   The Lessee undertakes not to organize any public or private gathering or particular event likely to generate the presence in the property of a number of people greater than the maximum number authorized as specified in the special conditions of the contract, except prior agreement of the Lessors. If such agreement is given, special security or service measures may have to be taken and the Lessee already accepts the said measures and their cost, of a minimum of 1,000 euros per day.

4I   Furniture and movable objects, including household linen, must only suffer depreciation resulting from the normal use for which they are intended. Those which, at the end of the rental period, are missing or have been put out of service, for a cause other than normal wear and tear, will be replaced or repaired by deduction from the security deposit paid by the Lessee. This clause also applies to papers, hangings and the building in general.

5I  The Lessee undertakes to use the furniture and objects furnishing the rented property for the use for which they are intended and in the places where they are located. It is strictly forbidden to transport them outside the rented premises.

6I   The Lessee must, within three days of taking possession, inform the Lessors of any anomaly observed.

7I  The Lessee must, at all times, allow personnel attached to the property to enter and work, whether for the performance of the services provided for in the description of the property, the protection, preservation, security of the property or the Lessee or urgent work necessary to maintain the rented premises and/or repair equipment items.

8I   Under penalty of termination, the Lessee may, IN NO EVENT, sublet or transfer its rights to the contract without the express consent of the Lessors; nor allow others to use the property in his absence.

9I   In the event of inappropriate use of the property, and in particular in the event of non-compliance with regulations regarding noise pollution or parking, or events leading to neighborhood disturbances, the rental may be terminated immediately. without reimbursement of the rental or the security deposit in the event of damage.

10I The Lessors declare that they have insured the buildings and furniture belonging to them with a reputably solvent company against the risks usually insured.

12I   The Lessee will take out multi-risk insurance in order to protect himself against rental risks (water damage, fire, etc.). A copy of the insurance policy may be requested by the Lessor from the Lessee upon entering the premises

OBLIGATIONS AND RESPONSIBILITIES OF LESSORS

1I The Lessors undertake to make the rented accommodation available to the Lessee in accordance with the description and to respect the obligations resulting from these conditions of sale.

2I The Lessors will do everything possible to ensure that the Lessee does not encounter any problems during the rental period.

3I   The Lessors will be responsible for routine maintenance and repairs to the property, including during the rental period. The Lessee will immediately inform the Lessors or their agent in the event of a malfunction of an installation or equipment of the property.

4IThe Lessors cannot in any way be held responsible for any loss, deterioration, theft or other damage to the property, belongings and personal effects of the Lessee or the occupants. The Lessee will be held responsible for any damage, any deterioration, any act of vandalism which could occur due to the occupation of the premises and/or due to the participants and/or the staff in his charge, both movable, decorative and real estate belonging or not to the property.

As a result, the Lessors can therefore ask the Lessee to leave the property without any compensation or reimbursement and to reimburse the damage caused by their actions.

5I Any complaint must be notified in writing to the Lessors within two weeks (14 days) following the Lessee’s departure.

TERMINATION

1I   In the absence of payment on the set deadlines or non-performance of any clause of this commitment and 48 hours after formal notice remains unsuccessful, the Lessors may demand immediate termination of the rental and the Lessee must leave the premises rented by simple order of the summary judge.

2I   The Lessors reserve the right to terminate any stay due to the unreasonable behavior of the Lessee or the Occupants.

APPLICABLE LAW AND COMPETENT COURTS

These General Conditions of Sale are governed by French law. This is the case for substantive rules as well as for formal rules. Disputes will fall under the exclusive jurisdiction of the French courts.

The Customer confirms that he has carefully read these General Conditions of Sale, that he has consulted a competent lawyer regarding the interpretation of the clauses and that he will be responsible for his own actions or inactions and for those of occupants entering the property during the stay.
